Terms and Conditions

Last updated: 2 October 2026

These Terms and Conditions apply when JCF Capital Pty Ltd ABN 51 657 626 947 trading as Settled With Joe, Credit Representative Number 496121 of YBR Aggregation Pty Ltd, Australian Credit Licence 390261 (“Settled With Joe”, “we”, “us”, “our”), provides finance broking services to you. They are read together with our Credit Guide, YBR’s Credit Guide, any credit proposal disclosure document or quote we give you, and our Privacy Policy. If anything in these Terms and Conditions is inconsistent with those documents or with your rights under the law, those documents and your legal rights prevail.

1. OUR SERVICES

We are a finance broker and mortgage broker. We do not lend money. We help you identify finance options, prepare applications and submit them to lenders, including banks and non-bank lenders, and we introduce clients to private lenders. Any loan is provided by the lender on the lender’s terms.

We arrange:

  • consumer credit regulated by the National Consumer Credit Protection Act 2009 (Cth) (the NCCP Act) and the National Credit Code, such as home loans, personal loans and car loans, as a credit representative of YBR Aggregation Pty Ltd; and
  • business and commercial finance. Credit used wholly or predominantly for business purposes is generally not regulated by the NCCP Act.

We do not provide financial planning, tax, legal or insurance services.

2. CREDIT GUIDES AND DISCLOSURE

As soon as it becomes clear that we are likely to provide you with credit assistance on consumer credit, we give you our Credit Guide and YBR’s Credit Guide. Together they set out:

  • who we are, our credit representative number and YBR’s Australian Credit Licence number;
  • the fees and charges you may have to pay;
  • the lenders we deal with most often;
  • the commissions we may receive and how they are worked out; and
  • how to make a complaint, including to the Australian Financial Complaints Authority (AFCA).

For consumer credit, when we suggest a particular loan or help you apply for one, we also give you a credit proposal disclosure document. It sets out any fees payable to us, an estimate of the commissions we may receive, the lender’s fees and other third-party fees, and the amount of credit you would actually receive.

We only give you these documents electronically if you have agreed to receive them that way.

3. OUR DUTIES TO YOU ON CONSUMER CREDIT

When we provide credit assistance to you on consumer credit regulated by the NCCP Act, including home loans, personal loans and car loans:

  • we must act in your best interests;
  • if there is a conflict between your interests and ours, we must give priority to your interests;
  • we must make reasonable inquiries about your requirements and objectives, and make reasonable inquiries about and take reasonable steps to verify your financial situation; and
  • we must not suggest a loan to you, or help you apply for one, if it is unsuitable for you.

These duties are set by law, and nothing in these Terms and Conditions reduces them. They do not apply to business or commercial finance that the NCCP Act does not regulate.

4. LOAN PURPOSE

Whether a loan is regulated consumer credit depends on what the money will be used for. We ask you about the purpose of each loan. A lender may ask you to sign a declaration that the credit is for business or investment purposes. That declaration must only be signed if it is true, and you can ask us about it, or get independent advice, before you sign.

5. APPLICATIONS AND APPROVAL

All applications are subject to the lender’s credit assessment, lending policy and eligibility criteria. We cannot guarantee that a lender will approve your application, or the amount, interest rate or terms it will offer. Interest rates, fees and charges are set by the lender and confirmed in the lender’s loan offer.

6. YOUR INFORMATION

You agree to:

  • give us complete and accurate information;
  • tell us about any change in your circumstances before your loan settles; and
  • tell us about any past bankruptcy, personal insolvency agreement or arrangement with creditors.

Applicants must be 18 or over. Giving false or misleading information to a lender can lead to an application being declined and may be an offence.

We handle your personal information under our Privacy Policy. We do not obtain credit reports ourselves. A lender you apply to may obtain your credit report with your consent.

7. IDENTITY VERIFICATION

Lenders must verify the identity of borrowers and guarantors. We ask you for identification documents and may verify them for this purpose.

8. HOW WE ARE PAID, AND COSTS

We are usually paid by the lender, through commission when a loan settles and sometimes ongoing commission while the loan continues. The commissions we may receive are disclosed in our Credit Guide and, for consumer credit, in the credit proposal disclosure document.

In some cases a fee is payable by you. Where that applies, we tell you the amount and you agree to it before we act:

  • For consumer credit, we give you a written quote before we provide credit assistance. The quote describes the services it covers, the maximum amount payable to us and what that amount relates to, and whether anything is payable if a loan does not go ahead. We do not provide the credit assistance until you have accepted the quote, we do not ask for more than the maximum in the quote, and we do not ask for payment for our credit assistance before we have provided it.
  • For business and commercial finance, any fee is set out in writing and agreed with you before we act.

Some applications need services from third parties, such as valuers, solicitors or accountants. We tell you in writing about any third-party cost before it is incurred, and you only pay it if you have agreed to it in writing.

9. MARKETING

We do not send marketing messages without your consent. Our Privacy Policy explains how to opt out.

10. YOUR RIGHTS UNDER CONSUMER LAW

Our services come with rights that cannot be excluded under the Australian Securities and Investments Commission Act 2001 (Cth), including that our services will be provided with due care and skill. Nothing in these Terms and Conditions excludes, restricts or changes any right or remedy you have under that Act, the Australian Consumer Law or any other law, where that right or remedy cannot lawfully be excluded, restricted or changed.

11. LIMITATION OF LIABILITY

Subject to section 10:

  • we are not liable for a lender’s decision to approve or decline your application, or for the terms a lender offers; and
  • if our services are not of a kind ordinarily acquired for personal, domestic or household use or consumption, our liability for a breach of a warranty that cannot be excluded is limited, where the law allows, to supplying the services again or paying the cost of having them supplied again.

This section does not limit our liability for loss caused by our negligence, our breach of these Terms and Conditions or our breach of the law.

12. CHANGES TO THESE TERMS

We may update these Terms and Conditions by posting a new version on our website. The version in force when you engage us applies to that engagement, unless you agree in writing to a later version.

13. ASSIGNMENT

You may not transfer your rights under these Terms and Conditions without our written consent. We may transfer our rights and obligations to a related entity or to a buyer of our business. If we do, we will tell you, and your rights under these Terms and Conditions will not be reduced.

14. GOVERNING LAW AND SEVERABILITY

These Terms and Conditions are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales. If any part of these Terms and Conditions is invalid or unenforceable, that part is removed to the extent necessary, and the rest continues to apply.

15. COMPLAINTS AND DISPUTE RESOLUTION

If you are not satisfied with our services, please contact us first:

We will acknowledge your complaint within 1 business day and give you a written response within 30 calendar days. If we need more time, we will tell you why before the 30 days end. As our licensee, YBR Aggregation Pty Ltd is responsible for our credit activities, and its dispute resolution process also covers complaints about us.

If you are not satisfied with our response, or we have not responded within 30 days, you can contact the Australian Financial Complaints Authority (AFCA). AFCA provides a free and independent dispute resolution service for consumers and small businesses. Time limits may apply. Using AFCA does not affect your right to take legal action.
