This website is operated by JCF Capital Pty Ltd ABN 51 657 626 947 trading as Settled With Joe, Credit Representative Number 496121 of YBR Aggregation Pty Ltd, Australian Credit Licence 390261 (“Settled With Joe”, “we”, “us”, “our”). These Terms of Use apply to your use of this website. Our finance broking services are covered by our Terms and Conditions, our Credit Guide and our Privacy Policy.

1. USING THIS WEBSITE

You may use this website to read information about finance and to send us an enquiry. You must not:

  • use the website for an unlawful purpose;
  • upload or send harmful code, or try to gain unauthorised access to our systems;
  • interfere with the operation of the website;
  • copy, scrape or harvest content from the website without our written permission;
  • send unsolicited commercial messages through the website; or
  • give false details or pretend to be someone else.

Our services are for people and businesses in Australia.

2. GENERAL INFORMATION ONLY

The information on this website is general information only. It does not take into account your objectives, financial situation or needs, and it is not financial product, tax or legal advice. Product features, interest rates, fees and eligibility criteria are set by lenders and can change at any time. All applications are subject to the lender’s credit assessment and eligibility criteria. Nothing on this website is an offer of credit.

3. OUR CREDIT SERVICES

We are a finance broker and mortgage broker. We arrange consumer credit regulated by the National Consumer Credit Protection Act 2009 (Cth), such as home loans, personal loans and car loans, as a credit representative of YBR Aggregation Pty Ltd under Australian Credit Licence 390261. We also arrange business and commercial finance, and we introduce clients to private lenders. We do not lend money, and we do not provide financial planning, tax, legal or insurance services.

Before we provide credit assistance, we give you our Credit Guide and YBR’s Credit Guide. Our Terms and Conditions explain our legal duties to you, including the best interests duty that applies to consumer credit.

4. ENQUIRIES AND COMMUNICATIONS

When you send us an enquiry, we will contact you about it by phone, email or SMS. We do not send marketing messages without your consent. We will only give you credit documents, such as our Credit Guide, electronically if you have agreed to receive them that way after we have explained what that means.

Information you give us through this website is handled under our Privacy Policy. This includes details entered in a partly completed enquiry form, as the Privacy Policy explains. Please make sure the information you give us is accurate.

5. COOKIES, ANALYTICS AND CAMPAIGN LINKS

This website uses Google Analytics cookies and third-party widgets, and records campaign tags in page addresses with any enquiry you submit. Our Privacy Policy explains what is collected and where it is held. You can block cookies in your browser settings, although some parts of the website may not display correctly if you do.

9. YOUR RIGHTS UNDER CONSUMER LAW

Nothing in these Terms of Use excludes, restricts or changes any right or remedy you have under the Australian Securities and Investments Commission Act 2001 (Cth), the Australian Consumer Law or any other law, where that right or remedy cannot lawfully be excluded, restricted or changed.

Subject to section 9, we are not liable for loss arising from your reliance on general information on this website in place of advice about your own circumstances, from the website being unavailable, or from the content of other websites. This section does not limit our liability for loss caused by our negligence, our breach of these Terms of Use or our breach of the law.

11. MISUSE OF THE WEBSITE

If you deliberately misuse this website or use it unlawfully, you are responsible for any loss you cause us as a result.

12. CHANGES TO THESE TERMS AND TO THE WEBSITE

We may update these Terms of Use by posting a new version on this page. The version on this page when you use the website applies to that use. We may change, suspend or stop the website at any time.

13. GOVERNING LAW

These Terms of Use are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.

14. SEVERABILITY

If any part of these Terms of Use is invalid or unenforceable, that part is removed to the extent necessary, and the rest continues to apply.

15. COMPLAINTS

If you have a complaint, please contact us first:

We will acknowledge your complaint within 1 business day and give you a written response within 30 calendar days. If we need more time, we will tell you why before the 30 days end. As our licensee, YBR Aggregation Pty Ltd is responsible for our credit activities, and its dispute resolution process also covers complaints about us.

If you are not satisfied with our response, or we have not responded within 30 days, you can contact the Australian Financial Complaints Authority (AFCA), a free and independent external dispute resolution scheme. Time limits may apply.
