Super used to be a quarterly bill. Now it leaves with every pay run.

  • Funding for unpaid super and super guarantee charge (SGC) assessments, often within 2 business days
  • Loans from $50K to $3M, secured against property or assessed on turnover
  • Employers, company directors and business owners with staff on the payroll
  • Old quarterly shortfalls, Payday Super assessments and director penalty exposure considered
  • Full-doc (tax returns), low-doc or alt-doc (BAS, bank statements or an accountant's letter instead) and no-doc options across our 90+ lender panel

Since 1 July 2026, super is due with every payday rather than once a quarter. For a business that relied on the quarterly gap to manage cash flow, that change puts real pressure on each pay cycle. If a quarter from before 1 July 2026 is also still owing, that amount stays under the old quarterly SGC rules, while any late payday since then can bring an ATO assessment that falls due on the day it issues. It can be worked through. Super guarantee debt finance is funding used to pay unpaid super and SGC to the ATO, so the amount owing becomes a loan with set repayments. Joseph Farhat and his team look at what you owe, how your payroll runs and what a lender will need, then tell you plainly what can be arranged.

Who we can help access finance

  • Employers who have received an SGC assessment for a missed or late Payday Super contribution and need to pay it now.
  • Businesses still carrying unpaid super from quarters before 1 July 2026 alongside the new per-payday obligation.
  • Company directors who have received a director penalty notice that includes unpaid super.
  • Employers with a large or seasonal workforce, where every pay run now carries its own super payment.
  • Businesses that made a voluntary disclosure to the ATO and now need the funds to pay the amount disclosed.
  • Employers who have received a Notice to Pay and want the charge settled before a late payment penalty is added.

How Super Guarantee Debt Finance Works

Under Payday Super, contributions must reach each employee's fund within 7 business days after payday, with some exceptions such as new employees. The rate is still 12%, now applied to what the ATO calls qualifying earnings, the pay that super is worked out on. Your accountant can confirm what counts for your payroll. When a contribution is late or short, employers no longer lodge an SG statement. The ATO assesses the SGC itself, and the charge is due on the day of the assessment. If it is still unpaid 28 days later, the ATO issues a Notice to Pay. If that is unpaid after another 28 days, a late payment penalty of 25% applies, or 50% if the employer had one in the previous 24 months. Under the new rules, that penalty generally cannot be remitted.

Finance for super debt usually works in two parts. A loan pays the ATO the amount owing, which can include old quarterly shortfalls and SGC assessed under the new rules. Where property equity is available, the loan can be secured against it, which lowers the rate and lengthens the term. A line of credit or working capital facility can then sit alongside it to fund super on each pay run while the business settles into the new timing. Joseph Farhat and his team review the ATO account, your payroll cycle and any security, match the file to a lender from our 90+ bank, non-bank, and specialist panel, and manage the application through to funding.

We are a finance broker, not a tax agent, accountant, lawyer or insolvency practitioner. Speak with your accountant first. They can confirm the amount owed, whether a voluntary disclosure is open to you, and whether the business can meet its debts as they fall due. If it cannot, a registered insolvency practitioner is the right person to speak to before any new borrowing.

What Lenders Assess for Super Guarantee Debt Finance

ATO account position
a current ATO account statement showing the SGC, any older super amounts and other tax owing.
Payroll size and frequency
how many staff you employ, how often you pay them, and how much super each pay run now needs.
Cash flow under the new timing
recent bank statements showing the business can meet wages, super and the loan repayment in the same month.
Reporting status
whether payroll reporting, BAS and returns are up to date.
Director penalty exposure
whether a director penalty notice has been issued and on what date, because it sets the timeframe the lender works to.
Security
a mortgage over property usually means a lower rate and a term measured in years. Unsecured funding runs shorter and is priced higher.
How the shortfall built up
a lost contract, a slow-paying customer or the move to per-payday super is understood. Repeated shortfalls with no plan to fix them are harder to place.

The Super Guarantee Debt Finance Process: What to Expect

  1. Talk to Joseph Farhat and his team about the amount owing, any notice and its date, and how your payroll runs. If funding looks difficult, you will hear that early.
  2. Share your ATO account statement, the SGC assessment or notice, recent business bank statements and a payroll summary. Your accountant or bookkeeper can usually supply these quickly.
  3. We identify the lenders on the panel that fund super debt, set out what each would cost, and check whether a facility for future pay runs can be arranged at the same time.
  4. The lender issues an approval with the rate, term, fees and security in writing. We go through the total repayment with you before anything is signed.
  5. Funds are paid to the ATO to clear the SGC or the agreed amount, and any facility for ongoing super is in place before your next payday.

Old super debt and future pay runs, planned together

Lender policy on super debt is not uniform

Your accountant stays involved
we work alongside the person confirming your figures and your tax position.

Frequently asked questions

What is super guarantee debt finance?
It is business funding used to pay unpaid super and super guarantee charge to the ATO. It can cover shortfalls from quarters before 1 July 2026 as well as SGC assessed under Payday Super. The lender pays the ATO the agreed amount, and you repay the lender over a set term. The amount owed is not reduced. It moves to a lender, on a schedule you can plan payroll around.
What does the super guarantee charge add on top of the unpaid super?
Under Payday Super, the SGC has four components. The first is the unpaid super itself. The second is notional earnings, which is interest at the general interest charge rate, compounding daily. The third is an administrative uplift of up to 60%. It can be reduced, in some cases to 0%, for an employer who makes an early voluntary disclosure. The fourth is a choice loading of 25%, capped at $1,200 per notice period. Your accountant can confirm how each component applies to your assessment.
Is the super guarantee charge tax deductible?
For paydays from 1 July 2026, the ATO states that the SGC is tax deductible, including all four components. Two related costs are not deductible: general interest charge on SGC that is paid late, and the late payment penalty. SGC from the old quarterly regime is not deductible either. Your accountant is the right person to apply them to your return, as we do not give tax advice.
Can one loan clear old quarters and fund the transition to Payday Super?
It can often be arranged as two facilities approved together. A term loan pays out older quarterly shortfalls and any SGC assessed since 1 July 2026. It is usually priced lower when secured against property. A line of credit or working capital facility then sits beside it for super on each pay run, drawn when payroll goes out and repaid as customers pay. A facility for future super suits a business that is trading profitably and needs help with timing. Joseph Farhat and his team will look at your payroll cycle and set out what lenders will consider.
Does unpaid super put me personally at risk?
It can if you are a company director. Directors can be personally liable for a company's unpaid super guarantee charge, as well as unpaid GST and PAYG withholding, the tax taken from wages. The ATO can start recovering from a director 21 days after it issues a director penalty notice, and that period starts when the notice is posted. The penalty is a parallel liability: any payment by the company or a director reduces everyone's liability, so paying the company debt in full clears the director penalty. Which other options remain open depends on how the debt was reported, and how those rules apply to super under Payday Super is a question for your accountant or lawyer. A loan can pay the debt. What happens next is the ATO's decision.
How quickly can the money reach the ATO?
Unsecured funding can often settle within 2 business days once the lender has your bank statements, payroll summary and ATO account statement. Property-secured loans take longer because a valuation and mortgage documents are needed. If you are working to the date on a director penalty notice or a Notice to Pay, tell us in the first conversation. Joseph Farhat and his team will look for a lender on the panel that can meet it.
Can I get super guarantee debt finance with low-doc or no-doc?
Often, yes. Several lenders assess super debt on recent bank statements and payroll records rather than full financials. Most still want payroll reporting and BAS up to date, so the full amount owing is known. No-doc options generally need property security and cost more. Joseph Farhat and his team will tell you which lenders on the panel accept which documents.
Do you work with borrowers with bad credit?
Yes, we do. Defaults, arrears with a supplier, or a mark on a director's personal file do not rule you out, and it is not something we will make you feel awkward about. A super shortfall and a credit listing often come from the same tight period. Several lenders on our panel weigh current revenue, payroll and any property equity more heavily than the credit file, and will price for the risk rather than decline it. What helps most is telling us early, so we approach the right lender first instead of adding enquiries to your file. Joseph Farhat and his team will tell you honestly what is achievable before you apply anywhere.
Why work with Settled With Joe to arrange your super guarantee debt finance?
Because you get one conversation instead of a round of applications. Most of the people we help with super debt are business owners and company directors with staff to pay and a date to meet: an SGC assessment due on the day it issues, a Notice to Pay, a director penalty notice, or older quarters that never got cleared. Those situations are not unusual to us and there is no judgement in the conversation. What matters to lenders is that the business is trading, payroll is under control, and the repayment fits alongside super on every pay run. Our panel covers 90+ bank, non-bank, and specialist lenders, so a well-documented file can go to a bank at a sharper rate, and there are still options when the scenario is complex or the money is needed this week. We are based in Sydney and work with borrowers Australia-wide. Joseph Farhat and his team will tell you honestly and early whether we can help and what is realistically achievable in your timeframe.
Do you give financial advice?
No. We do not guide you on your finances, nor give financial advice. We focus on outcomes and solutions of presenting your unique scenario to the right lender so you can access funding in a timely and compliant manner.
Do you help with super guarantee debt finance outside Sydney?
Yes. Settled With Joe is based in Sydney and arranges super guarantee debt finance Australia-wide, covering both metro and regional areas. We work with employers in Sydney, Melbourne, Brisbane, Perth, Adelaide, and Canberra, as well as regional areas including Newcastle, Wollongong, Geelong, Gold Coast, Sunshine Coast, and Toowoomba. Lender appetite and policy can vary by location and by industry. Joseph Farhat and his team will identify which lenders on the panel are the best fit for your payroll and timeframe.
